The Legal Strategy Behind Stenonymous Publishing

To be read aloud in court if Veritext ever gets the courage to sue me for accusing them of fraud, something that would arguably be per se defamation if it wasn’t 100% true.

I sort of addressed this sometime ago, but here it is.

I’ve said many times associations do not have the proper legal structure to address the issues of our time. Simply put, associations may be viewed as collectives of independent contractors under the law and therefore cannot really speak out against a company or condemn business practices of a company without possibly finding themselves accused of antitrust violations.

This is related to why associations train us that we cannot discuss rates despite the fact that that is a lie and an oversimplification of the truth meant to reduce their own legal liability that does not educate and actively misinforms the people these organizations claim they exist for, the working reporter.

As a citizen of the United States, I have no such restriction. And I’ve shown that through initiatives such as my publishing against Speech-to-Text Institute, an organization that I accused of fraud that later shut down its website and got sued. I’ve also shown that through the Court Reporter Rates Discussion Facebook Page initiative. Thousands of people discussing rates. Thousands of people revealing the lie day by day for three years now.

But there’s a second part of the strategy I’ve told very few trusted confidants that I am now ready to reveal to the world.

I have littered social media accounts with all sorts of posts ranging from informative to offensive. I very quickly learned after my first hospitalization in 2021 that professional journalists tend not to cover the actions of people like me for a healthy variety of reasons that range from discriminatory to professional ethics. This is what I learned through years of trying to get the fraud that the corporations had taken part in more coverage. Too small for the feds and state meant too small for most media, and since there was no media coverage, federal and state governments didn’t care and wouldn’t look. This is a circular problem that reinforces itself. Nobody cares, so nobody cares, and in the end you just look like a crazy jackass writing about what only a relatively small population cares about. It still impacts thousands of people, but nobody cares about those thousands of people except the crazy jackass.

But if you don’t mind looking like a crazy jackass, you can cover a lot of ground and leave thousands of breadcrumbs for students, court reporters, and others to stumble across over many years and many platforms. Real information interwoven into the madness meant to bait journalists, such that anyone who looks closely enough starts to realize it’s a game, and anyone that doesn’t look closely enough runs the risk of giving me more publicity by reposting or sharing the things that I have written, good or bad. All publicity is good publicity.

And anyone dumb enough to sue gives a platform for the writing to be entered into the record for as long as courts keep records. This is in addition to the fact that paying a lawyer to review hundreds or thousands of posts for discovery over multiple platforms is a lot more money than anyone wants to spend on an idiot that, if you could even win, doesn’t have anything for you to collect.

Put another way: With my limited funding I have done as much as one can reasonably do. Thank you to every past and present supporter.

This creativity was inspired by the private equity folks who, long story short, do dirty shit like take a business they own, sell the land to some other business they own, make business A pay rent to business B, and saddle business A with tons of debt to pay themselves while selling business A off to some sucker as it collapses. This has been used to hurt hospitals for poor people and kill Red Lobster, which is only returning because some other sucker said “I can figure out how to make money here.” Asset stripping is cool and all, but it hurts real people and destroys real jobs. Point being, this is kind of the opposite, making a business out of publishing against businesses and organizations run by assholes who are hurting real people whether or not the New York Times wants to cover it.

In the end there’s no actual script to life. If 30,000 court reporters said “wow, we see the vision, here’s $100”, we could spend the next 30 years building a media company that does what I did to STTI on an industrial scale. I figure it this way: We pay the National Court Reporters Association millions of dollars every year to pretend to advocate for us and our interests while it actively misinforms reporters and potentially violates antitrust laws to take more of their money. How much would people put up for an organization that can actually aggressively defend the rights of court reporters? An organization that refuses to lie for the convenience? The private corporation or sole proprietorship structures allow for this legally in a way that nonprofit associations simply don’t. Other popular nonprofits like Protect Your Record Project do good advocacy work and education, but have limited scope and funding.

So I must renew my call for funding. If you are tired of agencies playing reporters against each other like puppeteers; if you are tired of the fraud and deceit these companies commit against lawyers, litigants, and the entire court reporting market; if you are tired of being lied to by the people and organizations you have trusted over decades to fight for you, look at the track record of someone who started this site to help students and young reporters who struggled the way that I struggled in the past because of all the market factors I have since written of that were hidden and that I too was lied to about. Look at the track record of someone who has fought relentlessly for people by leveraging free speech and information dispersal — a proud American tradition!

Look at all I have done as a strategy spanning so many years, calculated to protect others from the market strategies being weaponized against them.

P.S.

I am still working on the unionization proposal for those that were interested. It’ll be a smaller scale than what I am proposing here. If what I am proposing here garners me enough donations, the union proposal will be folded into it. It is important to note the union proposal only applies to the willing. Those who do not wish to unionize cannot be forced.

This concludes the portion that will be read aloud in court, for legal reasons, to be explained by a lawyer at the appropriate time.

Enjoy Election Day.
